Complex environmental legislation may impose significant environmental liabilities on purchasers, sellers, lenders, banks or other parties involved in a business or property transaction.
The aim of an Environmental Due Diligence Audit (EDD) is to identify and evaluate actual and potential environmental liabilities and risks associated with a property to be transferred and thus provide the clients with a baseline for decision-making and timely management of their risks during such a transaction. The first step of an EDD Audit is a Phase I Environmental Assessment eventually followed with a Phase II Site Assessment.
We conduct EDDs for single industrial or commercial propertiesand frequently includes an evaluation of the compliance status of the site and operations conducted at the site.
In general, the Phase II ESA involves a focused soil, soil-gas or groundwater sampling and analysis programme. Based on the information obtained through the Phase I ESA—site geology, hydrogeology, nature of the anticipated subsurface impact, nearest sensitive receptors, migration pathways, etc.—and on your particular objectives and needs, we develop a site specific investigation strategy and sampling and analysis programme, and selects optimal drilling and sampling techniques and chemical analysis methods.
We cooperate with qualified and reliable subcontractors for field activities (drilling, sampling, surveying etc.) and accredited environmental laboratories for scientific analyses.
Phase II ESA data are compared with the national environmental standards. The significance of detected subsurface impact is evaluated with respect to local and regional environmental conditions and the presence of sensitive receptors such as groundwater or surface water uses, background environmental quality, proximity to residential areas, etc.
As a final result of the Phase II ESA, we provide you with options and recommendations for follow‑up activities such as further investigation, monitoring, risk assessment or remediation.
